In a recent judgment, Justice Nyang Ekwo of the Federal High Court in Abuja has affirmed the legitimacy of Governor Peter Mba of Enugu State’s National Youth Service Corps (NYSC) certificate, asserting that it was lawfully issued by the corps.
During the court proceedings, Justice Ekwo reviewed the evidence and noted that although the governor had been mobilized for service in 2001, he successfully completed his service in 2003.
The court revealed that Governor Mbah, while midway through his service, had obtained permission from NYSC to attend the Nigeria Law School and was subsequently reinstated into the NYSC in 2003.
Justice Ekwo further emphasized that the evidence showing Mbah’s service in the law firm of one Udeh was uncontested by the NYSC. However, he criticized the corps for failing to charge the governor with forgery, despite their belief that the NYSC certificate had not been issued to him.
Concluding the case, Justice Ekwo characterized the NYSC’s actions as mischievous and in bad faith for denying Mbah’s NYSC certificate.
The court ultimately found the Director General and the NYSC guilty of misrepresenting material facts and ordered them to pay N5 million in damages.
